The first transvaginal mesh [“TVM”] case involving J&J’s Gynecare Prolift mesh used for pelvic organ prolapse [“POP”] & associated incontinence was tried to a jury in New Jersey & resulted in a verdict of $3.35 million in compensatory damages for plaintiff, Linda Gross. The trial lasted almost 3 weeks. Ms Gross was a Registered Nurse who suffered through eighteen [18] surgeries trying to repair the damage that the Prolift caused. She was disabled as a result.
In addition the second phase of the trial included a punitive damage claim to punish the company for their actions. The jury reviewed the evidence presented & awarded $7.76 million in punitive damages against Johnson & Johnson’s Ethicon Inc. for their conscious disregard for Ms Gross’s health & safety and their reckless, willful conduct in the design, manufacture, marketing, labeling, testing and inadequate warnings regarding their Prolift device. There were plenty of damaging documents, memos and testimony from the company itself showing that J&J knew this product was defective, untested and unapproved at the time they marketed it— but they sold it to Drs & vulnerable women anyway.
Women who have been injured by this device should not blame their doctors because the majority of the implanting Drs were deliberately misled by the company; Drs are not biomaterials experts. Implanting Drs rely on the medical device company through its sales reps to tell them the truth about the testing and adverse events, risks and benefits of the device. This has not happened with this product, or any of the TVM products for that matter. In addition, when the Drs are misled, so are the consumers, as evidenced by the consumer oriented brochures & other sales & marketing tactics directed to both Drs & consumers. All of this came out in this first trial.
